TERMS OF SERVICE

Last updated: July 6, 2026

1. Overview

Welcome to Grace Upon Grace.

The terms “we,” “us,” and “our” refer to Grace Upon Grace. We operate this online store and provide handmade and customizable hair accessories, including hair bows, hair clips, and related products.

Our online store is powered by Shopify, which provides the e-commerce platform that enables us to offer our products and services online.

These Terms of Service (“Terms”) govern your access to and use of our website, online store, products, features, content, and related services (collectively, the “Services”).

By accessing our website, placing an order, purchasing a product, or otherwise using our Services, you agree to be bound by these Terms, together with our:

  • Privacy Policy
  • Return, Exchange and Refund Policy
  • Shipping Policy
  • Any other policies displayed on our website

If you do not agree with these Terms, please do not use the Services.

Nothing in these Terms is intended to exclude, restrict, or override any rights or remedies that cannot lawfully be excluded under applicable law.

2. Eligibility and Customer Information

By using our Services or placing an order, you confirm that you are legally capable of entering into the relevant transaction under applicable law.

Our products may be intended for babies, toddlers, and children; however, purchases through our website should be made by adults or persons legally capable of entering into the transaction.

When placing an order, you agree to provide accurate, current, and complete information, including where applicable:

  • Name
  • Email address
  • Phone number
  • Billing information
  • Shipping address
  • Customization details
  • Other information reasonably required to process the order

You are responsible for ensuring that all information submitted is correct before confirming your order.

We are not responsible for delays, failed deliveries, incorrect customization, or other issues caused by inaccurate or incomplete information provided by the customer, except to the extent otherwise required by applicable law.

3. Our Products

Grace Upon Grace specializes in handmade and customizable hair accessories, which may include:

  • Hair bows
  • Hair clips
  • Baby and toddler hair accessories
  • Personalized accessories
  • Made-to-order products
  • Custom colour combinations
  • Theme-based products
  • Initial or name-based products
  • Product sets and combinations

Product availability may change without prior notice.

We reserve the right to:

  • Introduce new products
  • Modify product ranges
  • Discontinue products
  • Limit quantities
  • Decline customization requests that we cannot reasonably fulfil

Any such action will remain subject to applicable law and confirmed customer orders.

4. Handmade Nature of Products

Many of our products are individually handmade.

Accordingly, minor variations may naturally occur between individual products or between a finished product and its photograph.

Such variations may include minor differences in:

  • Bow folds
  • Shape
  • Stitching
  • Fabric pattern placement
  • Print positioning
  • Embroidery positioning
  • Texture
  • Dimensions within reasonable handmade tolerances
  • Placement of decorative elements
  • Overall finishing

Reasonable variations inherent to handmade production are part of the character of handmade products and are not automatically defects.

However, this clause does not exclude any rights available to a customer where a product is genuinely defective, damaged, materially misdescribed, unsafe, or otherwise gives rise to rights under applicable law.

5. Product Images and Colour Representation

We make reasonable efforts to display our products accurately.

However, actual colours may appear slightly different due to factors such as:

  • Screen settings
  • Device displays
  • Display calibration
  • Photography lighting
  • Ambient lighting
  • Camera processing
  • Browser settings

Where product photographs are edited or enhanced for presentation, our intention is to represent the actual product as accurately as reasonably possible.

We do not intentionally alter product photographs in a manner that materially misrepresents the product being sold.

Minor screen-related colour differences do not automatically constitute a product defect. However, nothing in this section limits rights relating to material misrepresentation or significant discrepancies where applicable.

6. Customization and Personalized Orders

Some products may be customized according to customer instructions.

Customization may include:

  • Names
  • Initials
  • Colours
  • Themes
  • Sizes
  • Fabric choices
  • Design preferences
  • Other agreed specifications

You are responsible for carefully checking all customization information before submitting or approving your order.

This includes:

  • Spelling
  • Names
  • Initials
  • Colour selections
  • Size selections
  • Theme selections
  • Other customer-provided instructions

We may rely on the information submitted or approved by you when producing the item.

If a personalized item is produced according to the information provided or approved by the customer, an error originating from the customer’s own submitted instructions will generally not be treated as an error by Grace Upon Grace.

Eligibility for cancellation, return, exchange, replacement, or refund of customized products is governed by our Return, Exchange and Refund Policy and applicable law.

7. Customization Feasibility

Submitting a customization request does not guarantee that every requested design can be produced exactly as imagined.

Certain requests may be affected by:

  • Material availability
  • Fabric availability
  • Colour availability
  • Size limitations
  • Technical feasibility
  • Handmade production constraints
  • Safety considerations
  • Design limitations

Where necessary, we may contact you to clarify or modify a customization request before production.

We reserve the right to decline customization requests that are impractical, unsafe, unlawful, infringing, or outside our production capability.

8. Orders and Acceptance

When you place an order, you are making an offer to purchase the selected product or products.

Receipt of:

  • An automated email
  • An order number
  • A payment acknowledgement
  • A website notification

does not necessarily mean that an order has been finally accepted in every circumstance.

We may decline or cancel an order where reasonably necessary, including because of:

  • Product unavailability
  • Material unavailability
  • Pricing errors
  • Technical errors
  • Payment failure
  • Suspected fraud
  • Inability to fulfil customization requirements
  • Incorrect listing information
  • Delivery restrictions
  • Unlawful activity

If we cancel a prepaid order after payment has been successfully received, we will process an appropriate refund in accordance with applicable law and our policies.

9. Order Review

Please review your order carefully before submitting it.

You are responsible for checking:

  • Product selection
  • Quantity
  • Size
  • Colour
  • Customization details
  • Name spelling
  • Initials
  • Delivery address
  • Phone number
  • Other order information

Because handmade and customized products may enter production after an order is confirmed, changes or cancellations may not always be possible once production has begun.

10. Order Cancellations

Cancellation requests should be submitted as soon as possible.

For standard products, cancellation may be possible before processing or dispatch, depending on order status.

For customized, personalized, or made-to-order products, cancellation may not be possible once:

  • Production has started
  • Materials have been specifically prepared
  • Personalization has begun
  • The item has been completed
  • The item has been dispatched

Any cancellation rights remain subject to applicable law and our published cancellation and refund policies.

11. Prices

Product prices are displayed on our website.

Prices may change from time to time without prior notice. However, changes will not ordinarily affect an order already accepted at a confirmed price, except where there is an obvious pricing error or where otherwise permitted by applicable law.

The final amount payable may include, where applicable:

  • Product price
  • Shipping charges
  • Taxes
  • Other charges clearly disclosed before order confirmation

We aim to disclose applicable charges before the customer completes the purchase.

12. Pricing Errors

Occasionally, a product may be listed with an incorrect price due to:

  • Typographical error
  • Technical issue
  • System error
  • Incorrect promotional configuration

Where a genuine pricing error occurs, we may contact you before fulfilment to:

  • Confirm whether you wish to proceed at the correct price, or
  • Cancel the affected order and issue an appropriate refund for amounts paid

We will handle such situations reasonably and subject to applicable law.

13. Payments

Payments may be processed through third-party payment service providers.

Available payment methods may vary depending on the options enabled on our website.

By submitting payment information, you represent that you are authorized to use the selected payment method.

We do not guarantee the uninterrupted availability of any particular payment method.

Payment transactions may also be subject to the terms, security procedures, and privacy practices of the relevant payment provider.

14. Shipping and Delivery

We aim to process and dispatch orders within the timelines communicated on our website or during the order process.

However, delivery dates and transit times are generally estimates unless expressly stated otherwise.

Delays may occur due to circumstances including:

  • Courier delays
  • Weather conditions
  • Natural disasters
  • Strikes
  • Transport disruption
  • Incorrect addresses
  • Remote-area delivery limitations
  • Public holidays
  • Government restrictions
  • Events beyond our reasonable control

We will not be responsible for delays beyond our reasonable control except where applicable law provides otherwise.

Any issue involving lost, damaged, misdelivered, or undelivered shipments will be handled according to the circumstances, our published policies, courier processes, and applicable law.

15. Returns, Exchanges and Refunds

Returns, exchanges, replacements, and refunds are governed by our separate Return, Exchange and Refund Policy.

Customers should review that policy before placing an order, particularly when purchasing:

  • Customized products
  • Personalized products
  • Made-to-order products
  • Sale or clearance products

Nothing in our Return, Exchange and Refund Policy or these Terms is intended to remove rights that cannot legally be excluded under applicable law.

16. Damaged, Defective, or Incorrect Products

Customers should inspect orders promptly after delivery.

If you receive an item that is:

  • Damaged
  • Defective
  • Incorrect
  • Materially different from the confirmed order

please contact us within the reporting period specified in our Return, Exchange and Refund Policy.

We may request reasonable supporting information, such as:

  • Order number
  • Photographs
  • Description of the issue
  • Photographs of packaging
  • Other relevant information

We will review the matter and provide an appropriate resolution where applicable.

17. Product Safety and Use

Our hair accessories should be used appropriately and with reasonable care.

Some products may contain:

  • Small parts
  • Clips
  • Decorative attachments
  • Beads
  • Embellishments
  • Other components

These may present a choking, ingestion, entanglement, or injury risk if misused, damaged, detached, or given to a child without appropriate supervision.

Accordingly:

  • Adult supervision is recommended for babies and young children.
  • Products should not be placed in a child’s mouth.
  • Products should not be used as toys.
  • Discontinue use if a product becomes damaged, loose, broken, or develops detached components.
  • Keep detached small parts away from children.
  • Remove accessories when appropriate, including where continued wear could create a foreseeable safety risk.

Customers and caregivers are responsible for using products in accordance with age appropriateness, product instructions, warnings, and reasonable supervision.

Nothing in this section excludes or limits liability that cannot lawfully be excluded, including liability arising from a defective or unsafe product where applicable law provides otherwise.

18. Intellectual Property

Unless otherwise stated, website content owned by or licensed to Grace Upon Grace may include:

  • Brand name
  • Logo
  • Product photographs
  • Original graphics
  • Website text
  • Product descriptions
  • Videos
  • Original design content

  • Website layout elements

Such content may be protected under applicable intellectual-property laws.

You may not, without appropriate authorization:

  • Copy our original product photographs for commercial use
  • Reproduce our website content for resale or commercial exploitation
  • Misrepresent our content as your own
  • Use our branding in a misleading manner
  • Republish substantial original content without permission

This section does not claim ownership over third-party materials, customer-owned content, public-domain materials, or intellectual property belonging to others.

19. Customer-Submitted Content

If you voluntarily submit content to us, such as:

  • Product reviews
  • Testimonials
  • Product photographs
  • Feedback
  • Suggestions

you confirm that you have the necessary rights or permissions to submit that content.

Where we wish to use identifiable customer photographs, especially photographs containing children, for marketing or promotional purposes, we may seek appropriate permission where required.

We will not claim ownership of your personal photographs merely because you send them for customer support, customization, or order-related purposes.

20. Reviews and Feedback

Reviews and feedback must not:

  • Be knowingly false or misleading
  • Infringe third-party rights
  • Contain unlawful content
  • Contain malicious software
  • Impersonate another person
  • Be submitted fraudulently

We may moderate or remove content where reasonably necessary and permitted by law.

Nothing in these Terms is intended to prevent customers from providing genuine, lawful feedback or reviews.

21. Prohibited Uses

You must not use our website or Services:

  • For unlawful purposes

23. Relationship With Shopify

Our online store is powered by Shopify, which provides the e-commerce technology used to operate the store.

Purchases from our store are transactions between the customer and Grace Upon Grace, not purchases from Shopify.

Shopify may process certain information and provide technical services according to its own applicable terms and privacy practices.

Nothing in this section excludes any responsibility that cannot legally be excluded.

24. Privacy

Our collection and handling of personal information is governed by our Privacy Policy.

We reserve the right to correct genuine errors and update information.

Where an error materially affects an order already placed, we will handle the matter reasonably and subject to applicable law.

The website may occasionally be unavailable because of:

  • Maintenance

28. Limitation of Liability

To the fullest extent permitted by applicable law, Grace Upon Grace will not be liable for indirect or consequential losses arising solely from circumstances beyond our reasonable control or from misuse of the Services or products.

  • Material misrepresentation
  • Consumer rights that cannot legally be waived
  • Other non-excludable liabilities

This clause must be interpreted subject to applicable law.

29. Indemnity

To the extent permitted by applicable law, you agree to be responsible for losses or claims arising directly from your unlawful use of the Services, deliberate violation of these Terms, or infringement of third-party rights.

This provision does not require a consumer to indemnify Grace Upon Grace for our own negligence, unlawful conduct, defective products, or obligations that cannot legally be transferred to the consumer.

We may suspend or restrict access to the Services where reasonably necessary because of:

  • Fraud
  • Security threats

32. Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be interpreted or severed to the minimum extent necessary, while the remaining provisions will continue in effect where legally possible.

33. No Waiver

If we do not immediately enforce a provision of these Terms, this does not necessarily mean that we waive our right to enforce it later.

34. Changes to These Terms

We may update these Terms from time to time to reflect:

  • Changes in our business
  • Changes in products
  • Changes in website functionality
  • Operational requirements
